§ 18-5. License required.

  • (a)

    A nonexclusive license to construct, operate and maintain a cable system within all or any portion of the town is required of anyone desiring to provide cable service in the town. A license may be granted by the council to any person, whether operating under an existing license or not, who offers to furnish and provide such cable system under and pursuant to the terms and provisions of this chapter.

    (b)

    A pilot program license may be issued for a pilot program for testing new technology or networking of a cable system, where radio or television services will be provided to not more than 75 residences, businesses, or other persons within the town, and are not provided for sale, subscription, advertising or promotional purposes of any kind. The town may issue a pilot program license without holding a public hearing, upon review and approval by the town public works director. A pilot program license shall have a term of 120 days, unless terminated sooner by licensee. The license may be renewed for a maximum of two additional terms. The public works director shall provide a copy of each license issued to the council.
