§ 1-93. Voting.

  • (a)

    The mayor shall vote as a member of the council.

    (b)

    The ayes and nays upon all questions shall be taken and entered in the minutes by roll call, voice vote or electronic vote.

    (c)

    Except as provided in subsection (d), actions of the council shall require the affirmative vote of a majority of all councilmembers present at any regular or special council meeting in order to become effective.

    (d)

    The following actions of the council shall require at least four affirmative votes in order to become effective:

    (1)

    Adoption of amendments to the Code of Gilbert.

    (2)

    Adoption of resolutions approving a new general plan or any amendments to the general plan.

    (3)

    Adoption of amendments to the Land Development Code.

    (4)

    Adoption of rezoning ordinances.

    (5)

    Actions on appeals from the planning commission or design review board.

    (6)

    Adoption of resolutions approving development agreements pursuant to A.R.S. § 9-500.05 or A.R.S. § 9-500.11.

    (7)

    Authorizing any eligible ballot item to be referred to the voters.

    (8)

    Adoption of the annual budget.

    (9)

    Adoption of a capital improvements plan.

    (10)

    Adoption of any property tax levy.

    (11)

    Adoption of changes to the sales tax rate.

    (12)

    Adoption of changes to fees and charges, including but not limited to utility rates and system development fees.

    (13)

    Approval of lease-purchase agreements or issuance of debt instruments.

    (14)

    Approval of amendments to personnel rules.

    (15)

    Approval of memoranda of understanding with employee organizations.

    (16)

    Authorizing the filing of any civil litigation.

    (17)

    Approving any non-binding public declaration or resolution on policy or political issues.

    (18)

    Removal of the town manager.
